07The Fine Print
Surge weeks are when 1099 shortcuts get taken, and caught.
In California, the expensive shortcut is paying event staff as 1099 contractors: back taxes, penalties, and joint-employer liability under federal FLSA and California workers' compensation law (Labor Code Div. 4). California's daily-overtime statute, Labor Code Section 510, pays time and a half after 8 hours in a day and double time after 12, with a seventh-day premium. During expo week, when every crew in the county is being offered extra shifts, the daily line is what separates a well-run surge from a payroll surprise.
